I just got an email that says the bill about carrying passengers has passed. The law went into effect July 1st
I am assuming it is now OK to do so.
Here is the bill as it was written:

136.12 84.9257 [PASSENGERS.]
136.13 (a) A parent or guardian may operate an all-terrain vehicle
136.14 carrying one passenger who is under 16 years of age and who
136.15 wears a safety helmet approved by the commissioner of public
136.16 safety.
136.17  For the purpose of this section, "guardian" means a
136.18 legal guardian of a person under age 16, or a person 18 or older
136.19 who has been authorized by the parent or legal guardian to
136.20 supervise the person under age 16.
136.21(c) A person 18 years of age or older may operate an
136.22 all-terrain vehicle carrying one passenger who is 16 or 17 years
136.23 of age and wears a safety helmet approved by the commissioner of
136.24 public safety.
136.25 (d) A person 18 years of age or older may operate an
136.26 ]all-terrain vehicle carrying one passenger who is 18 years of
136.27 age or older.

I did'nt know it was against the law to carry a passenger, I knew they were'nt meant to. Apparently I've been breaking the law since the first four wheeler came out. We used to have four people on the four wheeler and three on my Enduro of course we were in our early teens so it would'nt have mattered if we did know and for the most part we never wore helmets even on the sleds.

I don't see a problem with it if done right. As in no off-camber and no hill climbs. I had a seat on the back of my Big Bear and had no trouble but I was careful.

The difference between a 2-up machine and a 1-up with 2 people on it is the 2 -up positions the passenger in front of the rear axle and the single rider bike puts the passenger behind the axle causing a "fulcrum" effect and making it way easier to tip over backwards......I suppose everone knows this but thought I would post it anyway
