“Shocked, stunned, scared, frightened,” Brad Loff said in describing how he felt when confronted by a shotgun-toting Marie Granville while joyriding on private property in a remote area of borough.

Mr. Loff, now 29, of Dickson City, was the first witness to testify at the civil trial arising from the Nov. 9, 1999, shooting on land owned by Silverbrook Anthracite Mining Co.

He is seeking damages from Mrs. Granville, who fired the shot, and Silverbrook operator Cary Kasa, who allegedly gave her the weapon without instructing her on its use.

The trial in Judge Carmen D. Minora’s courtroom is expected to continue through at least Friday.

Mr. Loff testified he and friends were riding four-wheeled, all-terrain vehicles in a wooded area that was not posted when they realized they had taken an unfamiliar dirt road.

As they turned around, he said, Mrs. Granville confronted them, standing five feet in front of him with the shotgun leveled. She ordered them to turn off the ATVs, and Mr. Loff said he raised his hands and began to get off his vehicle.

“Lady, we’re not bad kids. We don’t cause problems,” Mr. Loff said he told Mrs. Granville.

His attorney, Vincent Cimini, asked how Mrs. Granville responded.

“She shot me,” Mr. Loff said.

On the witness stand later in the day, Mrs. Granville testified she went to the Silverbrook property to help Mr. Kasa clean up a trailer that had been vandalized. Mr. Kasa left the loaded shotgun at the trailer when he went to another part of the 1,200-acre property, she said.

Mrs. Granville testified Mr. Loff and his friends were using foul language and laughing. The Mayfield woman, who said she had never used a gun, testified she intended only to scare Mr. Loff with the weapon — not shoot him.

“They were acting so crazy. … When I picked up the gun, the gun went off by accident,” she said.

Much of her testimony dealt with her employment status. She said she worked as Mr. Kasa’s secretary for about a year and a half, beginning in 1996, but was not employed by him or Silverbrook in November 1999.

However, in a statement she gave to police after the shooting, she said the shooting occurred at her workplace and identified Mr. Kasa as her boss. She also called police on Mr. Kasa’s behalf in 1998 and 1999 to discuss vandalism on the property.

Jurors viewed an X-ray showing the 42 to 50 shotgun pellets Mr. Loff said are still embedded in his right forearm. He also displayed his scar to jurors, three of whom elected to don latex gloves to feel the pellets under the skin.

Mr. Loff, who is righthanded, told the jury he can perform everyday tasks, like washing dishes, but strenuous or repetitive activities are painful.

“It feels like sandpaper in your arm,” he said.
